Terms of Use
Article 1 Company name
Logista France, a Société par Actions Simplifiées (simplified joint stock company) with share capital of 107,250,000 euros, whose registered office is located at Immeuble Le Bristol - 27, avenue des Murs du Parc, 94300 Vincennes, registered with the Créteil Trade and Companies Registry under number 495 361 602, (hereinafter referred to as ‘Logista France’).
Logista France acts as an approved supplier for the distribution of tobacco products and related products to the network of tobacconists in France.
Article 2 Purpose
The purpose of these General Terms and Conditions of Use (hereinafter referred to as the ‘GTCU’) is to govern the terms and conditions for the provision and use of the services available on the Logista France corporate website available at the following URL: https://www.logistafrance.fr/ (hereinafter referred to as the ‘Site’).
Article 3 Legal Notices
The Director of Publication is Mathilde KESZEY-GOFFARD.
The Site is published by Logista France.
The Site is hosted by Logista France.
Article 4 Definitions
Users: designates any individual or legal entity who visits one or more pages of the Site.
Site: refers to the Logista France SAS website accessible from the following Internet page https://www.logistafrance.fr/.
Article 5 Acceptance and modification of the GCU
Access to and use of the Site are subject to acceptance of and compliance with these GCU.
By browsing the Site, whatever the technical means of access and the terminals used, the User is presumed to be aware of these GCU and to accept their terms without reservation.
These GCU apply, as necessary, to any variation or extension of the Site.
The GCU may be modified at any time by Logista France due to the evolving nature of the Site, which may be subject to modifications, in particular by making new features available or by removing or modifying certain features.
The User is therefore advised, before any browsing, to refer to the latest version of the Site's GCU, which can be accessed at any time on the Site.
Article 6 Intellectual Property
The trademarks, logos, signs and any other content of the Site are protected by the French Intellectual Property Code and in particular by copyright.
The User undertakes to use the content of the Site in a context strictly related to his/her capacity as a Logista France paying Customer.
All information or documents (text, animated or non-animated images, databases, sounds, photos, know-how, products mentioned) contained on the Website as well as all elements created for the Website and its general structure are the property of Logista France. This information, documents or elements are subject to copyright laws as soon as they are made available to the public on this Site. Logista France does not grant any license or any right other than that of consulting the Site. The reproduction of any documents published on the Site is authorised solely for the purposes of information for strictly professional use. Any reproduction or representation, in whole or in part, of the Site, or of any of its components, on any medium whatsoever, for any other purpose, in particular for commercial purposes, is expressly prohibited.
Article 7 Liability
Connection to the Site implies knowledge and acceptance of the characteristics and limits of the Internet, in particular as regards technical performance, response times for consulting, querying or transferring information, the risks of interruption, and more generally, the risks inherent in any connection and transmission on the Internet, the lack of protection of certain data against possible misappropriation and the risks of contamination by any viruses circulating on the network.
As a result, Logista France may not under any circumstances be held liable for, but this list is not exhaustive:
- the transmission and/or reception of any data and/or information on the Internet ;
- any malfunction of the Internet network preventing the proper progress/functioning of the Sponsorship Offer;
- failure of any receiving equipment or communication lines;
- loss of any paper or electronic mail and, more generally, loss of any data;
- routing problems;
- the functioning of any software;
- the consequences of any virus, computer bug, anomaly or technical failure;
- any damage caused to a participant's computer;
- any technical, hardware or software failure of any kind, which prevents or limits the possibility of benefiting from the Strator + services or which damages a participant's system.
It is specified that Logista France may not be held liable for any direct or indirect damage resulting from an interruption, malfunction of any kind whatsoever and for any reason whatsoever, or for any direct damage resulting in any way whatsoever from a connection to the Site. All Customers are entirely responsible for their connection to the Site and use of the services.
Logista France reserves the right, at any time if circumstances so require and in particular due to any event beyond its control, without any claim being able to be made in this respect and without its liability being incurred as a result, to stop or interrupt the Service Offering.
Article 8 Personal data
Logista France is responsible for processing the personal data collected and undertakes to guarantee the confidentiality of the personal data communicated by the User, as well as processing in compliance with Law No. 78-17 of 6 January 1978 relating to information technology, files and freedoms, known as the ‘Information Technology and Freedoms Law’, as amended by Law No. 2004-801 of 6 August 2004 and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, which came into force on 25 May 2018.
The User is invited to read the Privacy Policy available on the Site.
Article 9 Use of Site content
Logista France endeavours to update the content of the Site and to provide accurate information. Nevertheless, Logista France cannot guarantee the accuracy and completeness of the data appearing on the Site. Logista France shall not be liable for any damages, direct or indirect, commercial or otherwise, resulting from the use of the Site.
Article 10 Access to the Site
Logista France endeavours to keep the Site accessible, but is under no obligation to do so. It is specified that access to the Site may be interrupted for the purposes of maintenance, updating or any other reason, in particular of a technical nature. Logista France shall not be held liable under any circumstances for such interruptions and the consequences thereof.
Article 11 Hypertext links on the Site
The hypertext links set up on the Site may lead to the websites of various partners or companies belonging to its Group. It is specified that Logista France has not verified all the sites that may be linked to its own, their content and the information contained therein, and therefore declines all responsibility for the content of these sites and the use made thereof.
Article 12 Applicable law and jurisdiction
These GCU are governed by French law.
The parties shall endeavour to resolve amicably, prior to any legal action, any dispute that may arise between them concerning the interpretation, validity, performance or non-performance of the GCU for any reason whatsoever.
In the event of persistent disagreement over the application or interpretation of the GCU, and in the absence of an amicable agreement, any dispute will be referred to the Créteil court.
